These Terms of Service ("Terms") govern your access to and use of the website and services of Aurora Information Services ("Aurora," "we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
Aurora provides AI-assisted creation, scheduling, and publishing of short-form video and social media content for small businesses, along with related digital marketing services. The specific scope, deliverables, and fees for any engagement are set out in a separate written proposal, statement of work, or order that references these Terms.
You agree not to use our website or services to violate any law, infringe the rights of others, distribute malicious code, or engage in fraudulent, deceptive, or harmful activity. We may suspend or terminate services for conduct that violates these Terms or exposes us to legal or reputational risk.
Fees, billing frequency, and payment terms are described in your proposal or order. Unless stated otherwise, fees are due as invoiced. Late or non-payment may result in suspension of services. Except where required by law or expressly agreed, fees are non-refundable.
Subject to full payment, final deliverables created specifically for you are yours to use for your business. Aurora retains ownership of its own pre-existing tools, workflows, templates, software, and know-how used to produce the deliverables. You grant Aurora a limited license to use your brand assets solely to perform the services, and you permit us to reference our work for you in our portfolio unless you request otherwise in writing.
Our services rely on third-party platforms and tools that we do not control. We are not responsible for changes, outages, account actions, or policy decisions made by those platforms, including content moderation or account suspensions.
Some deliverables may be produced or assisted by artificial intelligence. We take reasonable care in producing content, but you are responsible for reviewing and approving content before or after publication as agreed, and for ensuring it is accurate and appropriate for your business.
Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific marketing results, engagement levels, or business outcomes.
To the maximum extent permitted by law, Aurora will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability arising out of or relating to the services will not exceed the amounts you paid to us for the services giving rise to the claim in the three months preceding the event.
You agree to indemnify and hold Aurora harmless from claims, damages, and expenses arising out of content or materials you provide, your use of the services, or your violation of these Terms or applicable law.
Either party may terminate an engagement as described in the applicable proposal or order. Upon termination, you remain responsible for fees incurred through the effective date of termination.
These Terms are governed by the laws of the State of Alaska, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Alaska.
We may update these Terms from time to time. Changes are effective when posted on this page, with an updated effective date. Your continued use of our website or services after changes take effect constitutes acceptance.
